In brief:
₿- The proposed framework introduces six investment assessment criteria and a process-based safe harbor to clarify fiduciary responsibilities when selecting alternative assets.
₿- Employers and retirement plan administrators will retain control over which cryptocurrency investment products are included in their 401(k) offerings, subject to federal fiduciary requirements.
The United States is considering a regulatory change that could make cryptocurrency and other alternative investments more accessible through 401(k) retirement plans. A new federal review of the Department of Labor’s (DOL) final rule could reshape how employers and retirement plan administrators evaluate digital assets, private equity, and real estate as potential investment options for American retirement savers.
The White House Office of Information and Regulatory Affairs (OIRA) received the final rule on November 5, 2026. Registered under identification number 1210-AC38, the measure focuses on establishing a framework for including alternative investments in employer-sponsored retirement accounts. Its scope includes cryptocurrency, potentially creating a clearer path for digital asset exposure through traditional retirement portfolios.
U.S. retirement investment rules set new standards for crypto

The latest regulatory development builds on a March 2026 DOL proposal designed to clarify the responsibilities of 401(k) plan fiduciaries when selecting alternative investments. Instead of imposing blanket restrictions on specific asset classes, the proposed framework emphasizes investment evaluation and risk management.
Under the proposal, fiduciaries would assess six factors when considering investment options: performance, fees, liquidity, valuation, benchmarking, and investment complexity. It also introduces a process-based safe harbor intended to provide greater legal protection to retirement plan managers who follow the prescribed evaluation procedures.
For cryptocurrency investments, this approach could reduce uncertainty surrounding fiduciary decision-making and give employers a more structured basis for considering digital asset investment products.
Trump’s executive order supports broader crypto access
The initiative follows President Donald Trump’s August 7, 2025, executive order, Democratizing Access to Alternative Assets for 401(k) Investors. The order directed federal agencies to reconsider regulatory barriers that could limit access to alternative investments in retirement accounts.

In May 2025, the DOL also withdrew its 2022 guidance, which had urged retirement plan fiduciaries to exercise extreme caution when considering cryptocurrency investments. The withdrawal removed that specific warning without eliminating fiduciaries’ existing obligations under federal retirement law.
Will Bitcoin become available in 401(k) plans?
The regulatory review does not automatically authorize cryptocurrency investments across U.S. retirement plans. Even if the final rule takes effect, employers and plan administrators will retain discretion over which investment products they offer, subject to their fiduciary responsibilities.
The rule must complete the federal review process before publication and implementation. If adopted, it could establish clearer standards for evaluating digital assets and other alternative investments, potentially expanding Bitcoin and broader cryptocurrency exposure through mainstream U.S. retirement accounts.
